Disputes are settled either by the court or by the parties. When the court decides the outcome, one of the parties is the winner, leaving the other party the loser. When parties settle their dispute, the parties determine their own outcome. Mediators are neutral and impartial, and facilitate the communication. With settlement by mediation, parties feel better, have fewer costs, and end the dispute early to return to their usual course of business without the distraction of the controversy and financial burden of paying attorneys.
